These terms describe the intended use of Tonewisp: Focus Music, including its music, noise, binaural tones, rhythmic pulses, visuals, work timers and optional Apple Watch features. They supplement the applicable app license and do not replace rights you have under law.
Not a medical app
Tonewisp is a music, entertainment and general-wellness app. It does not provide medical advice, diagnosis, monitoring or treatment, and is not intended to function as a medical device. It is not intended to diagnose, treat, cure, mitigate or prevent any disease or medical condition, including ADHD, anxiety or sleep disorders.
References to focus, study, relaxation, recovery, binaural beats or research describe listening experiences, not proven medical benefits. Tonewisp does not measure your brain activity or determine whether you are in a particular brain or cognitive state. No improvement in cognition, mental stamina, sleep, health or performance is guaranteed. Individual experiences vary.
Professional care and Watch data
Do not use Tonewisp as a substitute for advice or care from a qualified healthcare professional, to make medical decisions, or to delay seeking care. Ask a qualified healthcare professional if you are unsure whether its sounds or moving visuals are appropriate for you, particularly if you have a condition affected by sound or visual stimulation.
Heart sync uses available Watch heart-rate readings only to influence music. Tonewisp does not assess those readings, monitor your health, detect medical problems or provide emergency alerts. Do not rely on Tonewisp in an emergency; contact local emergency services instead.
Use comfortably and responsibly
You choose whether, when and how to use Tonewisp. Keep listening volume at a comfortable level, take breaks, and stop using the app if you experience discomfort or other adverse symptoms. Seek appropriate medical advice when needed. You can turn off binaural tones and rhythmic pulses, reduce visual motion or use a still image. Do not use immersive sound or visuals while driving or doing activities that require your full attention.
Health risks and limitation of liability
Use of Tonewisp is voluntary and at your own risk, subject to your rights under applicable law. To the fullest extent permitted by applicable law, Tonewisp's developer and service providers disclaim liability for injury, illness, adverse health effects or other loss arising from or related to your use or misuse of the app or reliance on its sounds, visuals, presets or Watch features. We do not warrant that the app is suitable for your individual health circumstances, free of risk or capable of producing a particular result.
Nothing in these terms excludes or limits liability or rights that cannot lawfully be excluded or limited. This includes liability for death or personal injury caused by negligence where applicable law prohibits its exclusion, and liability for fraud, gross negligence or willful misconduct where it cannot legally be limited. Your mandatory consumer rights remain unaffected. Where a limitation is not permitted, it applies only to the extent the law allows.
Subscriptions and free access
Tonewisp includes 30 minutes of free listening per day on each device. Active listening sessions, including recovery periods, count toward the allowance; paused time does not. Free access does not automatically become a paid subscription.
Tonewisp Plus unlocks unlimited listening for a monthly fee. The US price is $3.99 per month; local prices are shown by the App Store before purchase. Payment is charged to your Apple Account upon confirmation. The subscription automatically renews monthly unless canceled at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the period ends. Manage or cancel through your App Store subscription settings. Canceling renewal retains access until the paid period ends, except where Apple revokes or refunds a purchase. Deleting the app does not cancel your subscription. Restore Purchases is available in Tonewisp Plus. Apple handles payment and refund requests under its terms and applicable law.
The app is licensed under Apple's Standard End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These listening and subscription terms supplement that agreement and do not limit rights that cannot be excluded under applicable law.
